Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ServBuilder platform and website operated by Service Builder, Inc. ("ServBuilder," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our platform, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using ServBuilder on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not access or use our services.

2. Description of Service

ServBuilder is a software-as-a-service (SaaS) field service management platform designed for small and mid-sized home service businesses. Our platform provides tools for scheduling, dispatching, quoting, invoicing, customer management, and mobile workforce coordination.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to active subscribers.

3. Account Registration and Security

To use ServBuilder, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Subscription and Billing

ServBuilder offers monthly subscription plans. No annual contract is required. A paid plan renews each month until you cancel. Cancel by emailing support@servbuilder.com. We will confirm by email.

• All fees are billed monthly in advance
• Prices are listed in US dollars and are subject to change with 30 days' notice
• Payments are processed securely through Stripe
• Refunds are not provided for partial billing periods after cancellation

If payment fails, we will attempt to notify you and may suspend access until the outstanding balance is resolved.

5. Payments through Stripe

Online and in-person card payments from your customers are processed by Stripe through Stripe Connect. To accept payments in ServBuilder you create or connect a Stripe account and agree to Stripe's own terms, including the Connected Account Agreement. Stripe, not ServBuilder, holds and pays out those funds to you. We are not a bank or a money transmitter.

Card payments: 2.9% + 30 cents per transaction. This rate includes Stripe's processing fees, with no other payment fees from ServBuilder. Refunds, disputes, and chargebacks on your customers' payments are between you, your customer, and Stripe. Dispute and refund fees are handled under the Stripe Connect terms, including the Connected Account Agreement. Those fees are not a ServBuilder payment fee on top of the card rate above.

You are responsible for the accuracy of the invoices you send, for sales tax, and for complying with the law in your state.

6. Text messages

Text messaging is not active during the beta. ServBuilder does not send text messages today. A phone number, including one entered on a form, is not consent to text and does not turn messaging on.

If we launch text messaging later, it stays off until you opt in separately. We will not treat a phone number already on file as that opt-in. After you opt in, ServBuilder may send texts through our messaging provider on your behalf, such as appointment confirmations, technician ETAs and payment links. You are the sender. Before you add a customer's number, you must have that person's permission to text them. That permission is optional and is not a condition of buying your services. Honor opt-outs, including STOP replies, and send help when someone replies HELP. Message frequency varies. Message and data rates may apply. Follow the Telephone Consumer Protection Act and carrier rules. By entering a customer's phone number after you opt in, you confirm you have that permission. We may limit or turn off messaging that breaks these rules or that carriers block.

7. AI features

Some features, such as AI quoting and scheduling suggestions, use artificial intelligence to draft quotes and make suggestions. AI output can be wrong or incomplete. You are responsible for reviewing it before you send it to a customer or act on it, including prices, scope of work and schedules. Do not rely on it for legal, tax, safety or code-compliance decisions. The content you submit to these features is processed by the AI providers listed in our Privacy Policy.

8. Limited Beta Access

ServBuilder is in a limited beta. Access is complimentary for accepted organizations. This is not a permanent $0 plan. No credit card is required to start.

• Beta lasts at least 8 weeks and continues until we are comfortable charging. We do not start billing on a calendar date alone.
• We give at least 30 days' notice before the first charge and collect a card then.
• After beta, organizations that stay on as continuous customers keep a founding rate of $49/mo Starter and $99/mo Professional. That is a locked founding rate, not free forever.
• Public list pricing is $79/mo Starter and $199/mo Professional, billed monthly. Current plan limits live on the pricing page.
• If you decide not to continue, you can export your data in standard formats before access ends. Program details live on the beta page.

During the beta, ServBuilder is provided "as is" with no uptime commitment and no service level agreement. We may have downtime, and we may change, remove, or cap features. Text messaging is not an active feature during the beta. We back up your data, but you should keep your own copies of anything critical, and you can export your data in standard formats. 9. Acceptable Use

You agree not to use ServBuilder to:

• Violate any applicable local, state, national, or international law
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the platform
• Use the platform for any purpose other than legitimate business operations
• Scrape, crawl, or harvest data from the platform without authorization
• Resell or redistribute access to the platform without written consent

10. Intellectual Property

All content, features, and functionality of the ServBuilder platform, including but not limited to the software, design, text, graphics, logos, and trademarks, are owned by Service Builder, Inc. and are protected by US and international intellectual property laws.

You retain ownership of any data you input into the platform. By using our services, you grant us a limited license to process and store your data solely for the purpose of providing the service.

11. Limitation of Liability

To the maximum extent permitted by law, Service Builder, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the platform.

Our total liability for any claims arising from or related to these Terms or the service shall not exceed the amount you paid to ServBuilder in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

ServBuilder is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

You may terminate your account at any time by emailing support@servbuilder.com. We may terminate or suspend your account at any time for violation of these Terms, with or without notice.

Upon termination, your right to use the platform ceases immediately. We will make your data available for export for 30 days following termination. What we delete after that, and how long it takes, is described in our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Douglas County, Nebraska.

15. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify account owners by email and update the "Last updated" date at the top of this page.

Continued use of the platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the platform and close your account.
